Also in 4 b) it says:
In terms of the lease and constitutional documents for the Leisure
Centre, Moray Leisure carry the risk for all property repairs and
upgrades to the fabric of the building. This would normally include
plant repair, upgrade and replacement. The change in legislation
relating to refrigerant gasses was however not reasonably foreseeable
by them and they have not made financial provision for this cost.
‘not reasonably foreseeable’? ‘have not made provision’? They knew 14 years ago!!
